Current legislation and the amount of pensions in the judiciary encourage people to leave the system early, said President Nicusor Dan at a press conference.
The head of state also said that, after reviewing the retirement requests he received for signature, 90% of them did not comply with the rule that a magistrate who wishes to leave the system must announce their intention at least 90 days in advance so as not to affect the work of the court where they work. A summary by Oana Bala.
Reporter: The head of state pointed out that he has received 76 retirement requests from magistrates so far, of which two have withdrawn their requests. In two other cases, the magistrates said they would not retire if it weren't for this flood of information about retirement conditions.
The analysis of the documents has been completed, and the decrees will be published on Friday afternoon.
Major problems with compliance with legal deadlines
President Nicusor Dan also pointed out that the analysis of the retirement requests raises a question for the Superior Council of Magistracy.
Nicusor Dan: What is this mess? Because 70% of the retirement requests do not indicate a specific retirement date. In my experience, whether you work in a bakery, in the automotive industry, in a fur factory, in engineering, or in design, people retire, but they are careful not to affect the production cycle and to plan ahead for the exact moment when they will retire. In 70% of cases, magistrates' retirement applications do not specify a precise date, and when they do, it is sometimes very close, such as "I want to retire in two weeks" or "please schedule me for the CSM meeting in three days so that I can attend the meeting", which is not normal.
Nicusor Dan mentioned that he wants to have a discussion with the prime minister, the minister of justice, and representatives of the magistrates by the end of this week in order to provide predictability in a context where the quality of justice is very important.
