The judges of the Constitutional Court are expected to announce on Sunday a decision on the referral from the High Court of Cassation and Justice, which challenged the second draft bill on the reform of the magistrates' pension system.
The law provides for an increase in the retirement age of judges and prosecutors to the standard age of 65 over the next 15 years, and that their pensions cannot exceed 70% of their net salary in their last month of employment, but the Supreme Court considers that this violates the independence of the judiciary and that magistrates would be discriminated against compared to other categories of beneficiaries of occupational pensions.
Prime Minister Ilie Bolojan explained that, beyond arguments of social equity, the economic situation requires changes to the conditions and retirement age in all areas that benefit from so-called special pensions.
