President Nicusor Dan has referred the matter to the Constitutional Court regarding the law approving the emergency ordinance introducing a new Single Electronic Register of Communicable Diseases.
In a Facebook post, the head of state points out that the law provides for the storage of all medical and personal data for the entire life of the person and for at least 180 days after death, without the right to request their deletion.
The president considers this to be a disproportionate interference in private life, contrary to Article 26 of the Constitution.
The document uses unclear terms, does not distinguish between those who have a reporting obligation and those who can access the data, and leaves essential issues to secondary administrative acts, Nicusor Dan further argues.
