The draft law on fiscal-budgetary measures is constitutional

The Constitutional Court rejected, today, the notification submitted by USR and the Force of the Right on the draft law on the fiscal-budgetary measures for which the Government pledged its responsibility in the Parliament.

The president of the CC, Marian Enache, declared that the law as a whole was declared constitutional.

Marian Enache: The Court found that the government's commitment to the draft law was aimed at a single and unitary goal, namely increasing revenues to the national public budget and reducing state expenses. In the framework of the constitutionality examination, under an extrinsic aspect, it was concluded that the procedure for adopting the law by engaging the responsibility of the Government respected the requirements of the Constitution and the jurisprudence of the Constitutional Court. Under the intrinsic aspect, the Court held that the legal provisions, punctually criticized by the authors of the objection of unconstitutionality, were adopted within the margin of appreciation and opportunity available to the legislator in financial-fiscal matters. Therefore, the constitutional judges decided with a majority of votes that the objection is unfounded, that the law as a whole is constitutional, declaring the rejection of the objection. After the reasoning of the Court's decision, the law can be promulgated by the President of Romania.
