CCR: Sentenced and rehabilitated persons may be members of the Government

CCR considers that the ban for convicted persons to be part of Government should cease for those having been rehabilitated, decriminalized or amnestied

The Constitutional Court of Romania (CCR) considers that the ban for convicted persons to be members of the Government should cease, according to the legislation in force, if they have been rehabilitated, decriminalized or amnestied.

The Court has published a statement of reasons for its decision of 4 May dismissing as inadmissible a petition from the People's Advocate concerning the article prohibiting convicted persons from being members of the Government.

The judges state that, under the legal provisions in force, the phrase "did not suffer criminal convictions" does not constitute a ban on acquiring the status of executive member in the case of persons benefiting from a decriminalization or amnesty law, or who have been rehabilitated by a court final decision.
